A US Army Special Forces soldier accused of exploiting classified information for profit on prediction markets faces legal action as investigators scrutinise the industry’s safeguards against insider abuse.

A U.S. Army Special Forces soldier accused of exploiting secret knowledge of a covert operation against Venezuelan president Nicolás Maduro has been granted bond, as federal prosecutors pursue a case that has drawn fresh scrutiny to the booming prediction-market industry.

Gannon Ken Van Dyke, who is stationed at Fort Bragg in North Carolina, is alleged to have used classified information about the mission to place a series of wagers on Polymarket, an online market where users can bet on everything from elections to sports and entertainment. According to federal filings, those trades generated more than $400,000 in profit.

Authorities say the bets were made in the days before and during the operation, which targeted Maduro in January. Van Dyke has been charged with unlawful use of confidential government information for personal gain, theft of non-public government information, commodities fraud, wire fraud and making an unlawful monetary transaction.

The case has intensified concerns about whether prediction markets are vulnerable to insider abuse as they grow in size and influence. Polymarket said it detected trading tied to classified government information, alerted the Justice Department and cooperated with investigators. The Commodity Futures Trading Commission has also brought a parallel complaint, while lawmakers and regulators weigh whether tighter guardrails are needed.

Van Dyke was ordered to return to a federal courthouse in New York next week as the case moves forward. Prosecutors say he could face lengthy prison terms if convicted, while his bond was set without requiring him to post cash.
